Fire Extinguisher Requirements for NSW Businesses: What You're Legally Required to Have

If you run a business in NSW, "having a fire extinguisher" isn't the compliance test. You need the right types, in the right places, serviced on schedule, and documented. Here's what's actually required, in plain terms — selection, placement, servicing, and a change that took effect in 2026.

The three things that make you compliant

Fire-extinguisher compliance in NSW rests on getting three things right, each tied to a standard:

1. 1Selection — the right type of extinguisher for the hazards present (governed by AS 2444).
2. 2Placement — enough units, in the right locations, correctly mounted and signed (also AS 2444).
3. 3Servicing — every unit inspected and tagged on schedule (governed by AS 1851).

Miss any one and you're non-compliant, even if you technically own extinguishers. Underneath all of it, WHS law requires you to provide and maintain a safe workplace, and fire equipment is part of that duty.

Selection: match the extinguisher to the hazard (AS 2444)

AS 2444 sets which extinguisher types a premises needs based on its fire risks. In practice: ABE dry chemical covers most general areas (Class A and electrical), CO2 protects server rooms and switchboards, and any premises with commercial cooking must have a wet chemical unit for Class F oil fires. General coverage alone isn't enough — high-risk zones like kitchens and significant switchboards need dedicated, correctly matched protection. Placement: enough units, correctly positioned (AS 2444)

Owning the right type isn't enough if nobody can reach it in time. AS 2444 requires, among other things:

• ✓A maximum travel distance of 15 metres to the nearest appropriate extinguisher for general Class A risks — measured along the path a person would actually walk, not in a straight line through walls.
• ✓Extinguishers mounted with the base clear of the floor and the handle within easy reach (roughly between 100 mm and 1,200 mm from the floor).
• ✓Units located near exits and along escape routes, clearly signed with the correct location and classification signage, and accessible at all times.
• ✓Kitchen wet chemical units and switchboard CO2 units positioned within the required distance of the hazard (typically 2–20 metres) — close enough to reach, far enough to use safely.

Higher-hazard sites (warehouses, workshops) need more units at higher ratings than a light-hazard office of the same size.

Servicing: keep every unit tagged (AS 1851) — now mandatory in NSW

Every installed extinguisher must be serviced and tagged on the AS 1851 cycle: a 6-monthly inspection, a more detailed 12-monthly service, and a 5-yearly pressure test (many units are replaced at that point). Records must be kept, and only an accredited technician can certify the service.

Importantly, in NSW this became mandatory from 13 February 2026 for Class 1b and Class 2–9 buildings under the Environmental Planning and Assessment (Development Certification and Fire Safety) Regulation 2021. If your building has a fire-safety schedule, up-to-date servicing is now a legal obligation, not just good practice — and out-of-date tags can undermine an insurance claim after an incident.
